Jordyn Weichert, Prosecutors charged 20-year-old resident of Oak Harbor Jordyn Weichert, the driver accused of causing the accident, on the island of the Superior Court of 9 September on three counts of vehicular homicide and two counts of vehicular assault.

Weichert is being held without bail in the Island County Jail. His indictment is scheduled for 20 September.

Numerous law enforcement officers in Whidbey, including the sheriff, said the accident was the worst in memory, in terms of number of lives lost.

While Washington State Patrol classified the drug-related accidents, prosecutors have not decided which drugs may have played role, as the toxicology results have not returned. Island County Deputy Prosecutor David Carman said Weichert was accused of “all alternatives” for vehicular homicide and vehicular assault, but that could change once the lab results are complete.

There are three pillars or versions of vehicular homicide and vehicular assault charges; the most serious involves driving under the influence. The points others focus on the recklessness and disregard for the safety of others.

Two men from the port of oak were passengers in the Blazer, Jacob Quistorf 25 years of age and Malloy, Francisco 26-year-old fatally injured in the accident. The driver of another vehicle, 33 years old, Brian Wood, of North Vancouver, British Columbia, also died in the accident.

Wood’s pregnant wife of 31 years, Erin Wood, was wounded, as Weichert and front seat passenger in the Blazer, 22 years old, Samantha Bowling Oak Harbor. Wood suffered internal head injuries, but survived both she and the baby. Bowling suffered a broken pelvis, court documents state.

Less than two hours after the accident, Detective Craig Cardinal with the Washington State Patrol arrived at the scene of the accident and decided to stop both Weichert and Bowling on suspicion of vehicular homicide. Cardinal wrote that the arrests were based on reckless act “remove clothing when traveling at 55 mph,” ill advised and drugs found at the scene. Weichert Both Bowling and blood was noted for the test.

Carman said he has to investigate the law and wait for more evidence before deciding whether to charge bowling with a crime.

The State Patrol report on the accident concluded, “it is believed that drugs were used by Ms. Weichert and Bowling and the occupants of other vehicle (the Blazer).”

Cardinal wrote that he found “heroin, cocaine, marijuana, syringes, scales, burnt paper used for heating and liquefaction of drugs, the paper again, the sugar used as reagents in cutting and packing material used for the sale of illegal drugs. ” The report indicates that drugs and paraphernalia of wine from the Blazer.

A deputy found a plastic bag with heroin in the pocket of Malloy and a gun fell from his pocket Quistorf, the cardinal wrote in his report.

Weichert, said a policeman who had smoked marijuana about 11 hours before the accident.

Cardinal wrote that the accident occurred after Weichert felt uncomfortable and asked to help lead Bowling while Weichert took off his sweatshirt. The vehicle crossed fully into the other lane, striking the upcoming 2004 Subaru.

If convicted of the charges, could face Weichert from six years and five months in prison to 12 years in prison under the standard sentencing range.
