Amber Portwood Rehab, Amber’s attorney tells HollywoodLife.com that Amber could be released from jail as early as Feb. 9 if she is accepted into the court-mandated rehab program.
Teen Mom star Amber Portwood, who has been in jail since Dec. 16 for violating probation, plead guilty on Feb. 6 to possession of a controlled substance as part of a plea deal. Her attorney Evan Broderick tells HollywoodLife.com exclusively that he’s confident that a court-mandated drug program is the right move to help Amber get her life back on track.

“We [tendered] an agreement to the court where she’ll go to drug court in lieu of taking a conviction of the new case,” Evan tells us. “If she completes drug court, she’ll get to have that case reduced or at least petition to have the case reduced down to a misdemeanor. If she violates though, she will have a five year exposure to prison.”

Amber is facing 25 months on her prior domestic battery conviction and 36 months for her new possession case. Evan came up with the plea deal to help Amber avoid prison and also to help her get healthy again. ”We had come up with the idea [of the plea deal] and kind of sold it to the prosecutors office,” explains Evan.

The program will last approximately 1-3 years, shares Evan. But while this is the agreement, Amber has yet to be accepted into the program. Drug court will discuss her situation on Feb. 9, and if she’s admitted into treatment, “they will most likely let her out [of jail].”

“I’m happy with the outcome so long as she does what she’s supposed to do,” says Evan. “I won’t be happy with it if she screws it up and goes away for five years. She really needs some structure. She was kind of young and obviously came into a large amount of money and didn’t have a whole lot of structure, picked up a drug problem and some other problems. The people who graduate from that program generally come out better people.”

Amber Portwood Could Spend 5 Years In Prison, Amber Portwood was close to seeing stripes behind bars before an Indiana judge gave the go-ahead, Monday, on a plea deal that allows Portwood to enter a rehab program rather than jail.

According to TMZ, Portwood agreed to enter a rehab facility to escape a five-year jail sentence stemming from a December 2011 arrest for drug possession, a class D felony, and probation violation. Portwood previously pleaded guilty to all charges.

But the plea deal does not afford Portwood an immediate get-out-of-jail-free card. She could spend up to two weeks in custody, during which time an evaluation by the Drug Court team will be conducted. Once accepted into the rehabilitation program, Portwood will be released from jail.

Portwood arrived in court wearing an orange-and-white striped jumpsuit, shackled at the hands and feet, to hear the judge’s approval of her rehab plea deal.

Teen Mom Amber Portwood Pleads Guilty To Possession Of Drugs, Teen Mom star Amber Portwood is back in jail after pleading guilty to her probation violation charges in a Madison County, Ind. court on Feb. 6.

Amber “plead guilty to possession of a controlled substance and her violation issues,” a court official tells HollywoodLife.com.

Amber has been “referred to Madison County drug court” as a result, explains the official. That’s the only term the judge mandated after Amber confessed.

According to the official, this is all part of the plea deal that Amber worked out with district attorney’s office.

TMZ reports the the plea deal keeps Amber from serving five years in prison is she goes to a court-order rehab program. But if Amber does not complete her program, she will be thrown in the slammer and her case will be permanently set on her record.

Amber is now back behind bars at the Madison County correctional facility, confirm both a jail official and the court official.

Amber violated most of the terms of her probation and was placed in jail back in December.
