James Murdoch & Charges, Son of Rupert Murdoch, James could face “the companies legal battles on both sides of the Atlantic that involve criminal charges, fines and confiscation of assets” in relation to the phone hacking scandal now clouding News Corporation. Murdoch fils, which is the Deputy CEO of News Corp, has admitted to misleading the British Parliament about the hacking. The conglomerate decided to shutter tabloid News of the world this weekend after revelations that the newspaper had hacked into the phones of victims of murder and kidnapping.
This coupled with reports that the tabloid paid police for information; it could mean a lot of problems Murdoch, both here and in Britain. The Guardian:
Payments could leave News Corp – and possibly James Murdoch himself – against the possibility of prosecution in the U.S. under the Foreign Corrupt Practices Act (FCPA) – Legislation to end the corporate misconduct that leads to severe penalties for those convicted of violating – and in the UK under the Regulation of Investigatory Powers Act 2000, which prohibits the interception of communications.
Tony Woodcck, a partner at law firm Stephenson Harwood City, said that Article 79 of the Act of 2000 allowed the criminal proceedings was not only against a company, but also a director or similar officer was committed crime with their “consent or connivance” or was “attributable to negligence on their part.” Woodcck said: “This could encompass a large number of people at the highest level within an organization as an executive – not just the person who” pushed the button “that allows the interception to take place or someone (perhaps less old), who encourages or was otherwise complicit in the violation, such as an editor. ”
This is not good news for Santiago’s master plan to wrest control of the empire dad in the future. As the Times points out, this is a “defining moment” for the young Murdoch, News Corp was restored to its former glory, or let the fruit of the putrefaction of his father works in the vineyard?
