Richard Franco, 28, will also spend five years on probation but had a burglary charge against him dismissed.

Prosecutors in Los Angeles say he will not spend any extra time in jail because of the 193 days he has already spent behind bars.

Franco was accused of breaking into a guest house at the 45-year-old’s Hollywood home in July last year.

He has also been ordered to undergo a year of psychological counselling and must stay away from the actress for the next 10 years.

The 28-year-old pleaded no contest to one count of stalking.

Halle Berry said Franco had “terrorised” her over three days from 9 July 2011 before he was arrested on the night of 11 July.

Prosecutor Wendy Segall said in early proceedings that the former Bond girl had been “in fear for her safety”.

Berry was the first African American to win the best actress Oscar in 2002 for her role in Monster’s Ball.

Earlier this month People magazine reported that she was set to marry for a third time, after her French actor boyfriend Olivier Martinez proposed.
