Cindy suggested that he forgot to pull the ladder up and the girl got into the pool when nobody was looking.
Baez said Casey did not call police because he panicked. It also alleged he was abused by her father as a child and her brother, who was given a paternity test to see if he was the father of Caylee. These factors also played a role in covering up her daughter’s drowning, he said.
“Casey should have called 911. That’s what she is guilty she is not guilty of murder. This is not a murder case,” Baez said.
Prosecutors disagreed and said the boy died of the pieces of tape placed over the mouth and nose. He also said an investigation showed Casey’s computer Web searches for chloroform, neck breaking and alcohol.
Caylee was reported missing in July 2008, a month after she disappeared. Cindy Anthony made the call to the police.
“I can not find my granddaughter. There’s something wrong. I found my daughter’s car today and it smells like it was a body in the damn car,” Cindy Anthony said in July 2008 called the police.
Casey was already in police custody by the time the child remains were found in a wooded area less than a mile from her home five months later. The autopsy could not determine the cause of death.
Casey had originally told the authorities that a babysitter kidnapped Caylee.
